The successful incumbent needs to have experience within Advisory / ACD and they will be responsible for the following duties:

FCA Applications:
  • Review and approve fund documentation for submission to the FCA;
  • Liaise with the FCA Fund Supervisions team in relation to queries on fund applications & ad-hoc requests for information.

Monitoring and Advice
  • Undertake and deliver appropriate and timely monitoring of the group's fund administration operations in accordance with the monitoring programme;
  • Assist with providing appropriate, consistent advice to queries from the business

Management Reporting & Committees
  • Ensure breach/incident reports are completed accurately & in a timely manner
  • Compilation of monthly management reports and quarterly breach analysis;
  • Tracking of issues raised and following up actions;
  • Membership of and reporting to monthly risk committee and other regulatory change project groups;
  • Review and comment on financial promotions for funds;
  • Approve new products and changes to products through the product committee;

The Person must be able to ensure that the Firm remains compliant with all the following:
  • Licensing requirements including FCA Regulations for the Firm, for the Approved Persons and for the Controlled Functions.
  • Training and Competence requirements of the Financial Advisors.
  • Regulatory Reporting requirements.
  • Threshold Conditions.
  • Conduct of Business including Advice process.
  • Treating Customers Fairly.
  • Suitability of Advice, Reports and the process of interaction with Clients.
  • All Record keeping requirements.
  • Adherence to Principles of Business Rules.
  • Adherence to Approved Persons Rules.
  • Fit and Proper requirements for each Staff members.
  • Training and Competence requirements of all every Staff member.
  • Complaints Handling.
  • External Reporting including Reporting to the Regulators.
  • Adherence with Financial Promotion rules.
  • Data Security.
  • Adherence with Data Protection Rules.
  • Adherence to Anti money laundering laws

Regulatory Compliance
  • Ensuring that the Company and the Fund is and remains in compliance with all of its statutory and regulatory obligations of each jurisdiction in which the Company renders services and/or in which the Fund is registered, authorized, promoted, marketed, distributed and/or otherwise offered for investment, whether directly or indirectly (collectively referred to as "distributed");
  • Maintaining a Regulatory Monitor detailing all regulatory returns due by the Company and/or the Fund including the due dates for such submission of such Regulatory Returns;
  • Ensuring that all statutory and regulatory returns of the Company and the Fund are filed timeously and accurately with any relevant regulatory authority, including without limitation, the Financial Conduct Authority, FINMA, FSCA, SCA, MAS, HMRC, Companies House, applicable Data Protection Regulators or equivalent;
  • Ensuring that the Company is kept apprised of all statutory and regulatory developments that may affect the Company, the Fund, its employees, investors/clients in each of the jurisdictions in which the Company operates and/or the Fund is distributed and shall identify and report on any such developments to the Head of Legal, Regulatory, Risk and Compliance and, if required, to the Board of the Company;
  • Engaging, under the guidance and instruction of the Head of Legal, Regulatory, Risk and Compliance, with the Financial Conduct Authority and/or any other regulatory authority on matters related to the Company;

Compliance and AML/CTF
  • Responsibility for ensuring compliance with applicable laws and regulations. These laws and regulations include the Companies Act, the UK Corporate Governance Code, MiFID II, AMLD4, GDPR, Corporate Governance Requirements (CP128), CP86, Benchmark Regulation, UCITS V, the FCA Handbook and Fitness & Probity (F&P) amongst others.
  • Developing, implementing and maintaining, under the guidance and direction of the Head of Legal, Risk, Regulatory and Compliance, the compliance framework and annual compliance plan to provide the Board and senior management with assurance across conduct and regulatory compliance risk.
  • Developing, updating and implementing, , under the guidance and direction of the Head of Legal, Risk, Regulatory and Compliance, the AML policies and procedures of the Company and ensure its compliance.
  • Identifying compliance risks and working with senior management to mitigate such risks and ensure that the business remains within its core risk appetite.
  • Designing, under the guidance and direction of the Head of Legal, Risk, Regulatory and Compliance, a comprehensive compliance monitoring programme to ensure that all aspects of the business are conducted in compliance with regulation and that any breaches are remediated promptly.
  • Analysing, implementing, under the guidance and direction of the Head of Legal, Risk, Regulatory and Compliance, and reporting to management on all applicable regulatory obligations, including business and regulatory developments and on the procedures required to ensure compliance with these obligations.
  • Maintaining the Company's register of compliance and AML/CFT training.
  • Ensuring, under the guidance and direction of the Head of Legal, Risk, Regulatory and Compliance, that effective processes are in place to identify and report suspicious transactions/sanctions/PEPs to UK regulatory bodies and respond to FIUs (where applicable)
  • Supporting the business in responding to the changing regulatory landscape (advising, reviewing and challenging), by monitoring upstream regulation & assessing direct impacts on the business.
  • Providing, under the guidance and direction of the Head of Legal, Risk, Regulatory and Compliance, effective liaison between the firm and the Financial Conduct Authority and any other Regulator and responding to queries from the wider business.
  • Monitoring and investigating any breaches of regulations and reporting any material breaches in compliance as required as soon as reasonably practical.
  • Providing, under the guidance and direction of the Head of Legal, Risk, Regulatory and Compliance, guidance to various departments (marketing, operations, advisory, clients services and transfer agency) on their privacy obligations;
  • Interpreting UK regulations and Financial Conduct Authority rules to, under the guidance and direction of the Head of Legal, Risk, Regulatory and Compliance, provide guidance in relation to regulatory matters (including regulatory projects) and practical application of the rules and regulations.
  • Development and enhancement, under the guidance and direction of the Head of Legal, Risk, Regulatory and Compliance, of governance and compliance related policies, procedures and presentations.
  • Reporting to the Head of Legal, Compliance, Risk and Regulatory and to the Board on the Company and the Fund's compliance with the applicable laws, regulations, guidance notes and directives.


Qualifications
  • Diploma in Compliance
  • Degree in either law, economics, business studies, accountancy or mathematics is preferable
  • Equivalent qualification FCA
  • The Person must be experienced in the Financial Advisory Firm working as the Compliance Officer and Anti money laundering officer and approved by FCA
  • Consistent and outstanding academic track record.


Skills & Experience
  • 5 - 8 years' experience in the financial services company /investment firm.
  • Strong FCA regulatory knowledge and experience on compliance including UCITS, AIFMD, MiFID & CASS
  • Understanding corporate governance and knowledge of global best practice / trends within the regulatory, compliance and governance framework.
  • Background in financial services regulation / law with knowledge of the South African and Global regulatory landscape including risk management would be beneficial.
  • Previous management experience would be desirable
  • European regulatory knowledge, including UK would be preferable
